Venti anni di Codice dei beni culturali e del paesaggio

The article traces the twenty years of the Code of Cultural Property and Landscape (Legislative Decree No. 42 of January 22, 2004). In particular, the analysis focuses on the context, legacy, and points of tension that characterized the preparation of the Code, the choices made, and the gaps in the legislation, as well as the trends toward change that have emerged in recent years. Finally, some concluding remarks are made on the overall assessment of these twenty years and the future of the Code.

L’articolo ricostruisce i venti anni di vita del Codice dei beni culturali e del paesaggio di cui al d.lg. 22 gennaio 2004, n. 42. L’analisi, in particolare, si sofferma sul contesto, sui retaggi e sulle tensioni che hanno caratterizzato la preparazione del Codice, sulle scelte compiute e sulle lacune della normativa, nonché sui filoni di modifica che si sono manifestati negli anni successivi all’entrata in vigore del provvedimento. Infine, sono formulate alcune considerazioni conclusive sul bilancio complessivo di questi venti anni e sul futuro del Codice.
