Politica e diritto nelle restituzioni di beni culturali

The article reconstructs the various hypotheses for the restitution of cultural property, identifying causes, remedies, and parties involved. Four categories are identified in particular: restitutions resulting from wartime spoliation; post-colonial restitutions; restitutions resulting from illicit trafficking in works of art; and restitutions due to Nazi-Fascist persecution. After presenting a selection of cases, the article focuses on the reasons for restitution, highlighting the role of law and suggesting the formation of an emerging customary law on restitution.

L'articolo ricostruisce le diverse ipotesi di restituzioni di beni culturali, individuando cause, rimedi e soggetti coinvolti. Sono in particolare identificate quattro categorie: le restituzioni derivanti da spoliazioni belliche; le restituzioni post-coloniali; le restituzioni derivanti da traffico illecito di opere d'arte; le restituzioni dovute alle persecuzioni nazifasciste. Dopo una antologia di casi, lo scritto si sofferma sui perché delle restituzioni, evidenziando il ruolo del diritto e giungendo a prospettare la formazione di un emergente diritto consuetudinario alla restituzione.
